    The Annual Legal Update

    Courts in Texas have issued many opinions in the last year that affect how POAs should be operating.  Understanding the cases and the outcomes will help you avoid pitfalls of association operations.

    • A recent Court rulings casts doubt on the enforceability of certain restrictions.
    • You can win some fights but at what cost?
    • Understanding the statute of limitations in deed restriction law suits.
    • TUCA insurance provisions enforced by the courts.
    • Have the courts expanded board member immunity?
    • Can an owner really sue a board member for breach of fiduciary duty?
    • Is it time to tighten up the association governing documents?

    Marc Markel and Clinton Brown | Roberts Markel Weinberg Butler Hailey, PC

    Marc Markel is one of Roberts Markel Weinberg Butler Hailey’s founding partners, Marc Markel has been practicing law for over thirty five years. Marc is experienced in handling all aspects of real estate transactions, litigation and community association representation. Marc has been listed on Thomson Reuters Super Lawyers from 2005-2012 and 2014-2017 and has also been featured in the Super Lawyers, "Corporate Counsel" Edition in the area of Real Estate. He has been recognized as a 2018 Best Lawyer by Best Lawyers in America. Marc is Board Certified in Residential Real Estate and Commercial Real Estate by the Texas Board of Legal Specialization and a charter fellow of the College of Community Association Lawyers (CCAL).     Mr. Markel has authored master deed restrictions for numerous large residential, commercial and mixed-use projects. He has actively defended community associations and their volunteers in litigation and frequently assists developers through their due diligence process and acquisition of title. His representation of developers, builders and associations involves litigation avoidance techniques in which he conducts a thorough risk analysis program.

    Mr. Markel is also a frequent speaker on real estate topics for various bar organizations and the Community Associations Institute (CAI).

    Clint Brown joined the firm’s real estate section in 2012. Mr. Brown represents community associations, developers, developer-controlled associations, and commercial associations throughout Texas and his practice area focuses on bankruptcy law, corporate law, and all aspects of community association law.
